THE REGULATORY “TSUNAMI”

Introduction


This 7th Mare Forum USA conference builds on the previous Mare Forum conferences held in New York and Houston from 2003 to 2011.

Representatives from Government and Maritime Industry will discuss and analyse the implementation and compliance on Ballast water management, air emissions, vessel general permit, maritime labour convention 2006, and other regulatory developments. They will formulate the priority issues that ship owners and managers, Flag Administrations and Port State Administrations must address to implement these new and evolving regulatory requirements, in a manner that realizes environmental benefits, but also allows implementation flexibility for ship owners and managers.

“Situation”
: International, United States and European Union regulatory development continues to accelerate and resulting in some cases of contradictory requirements.  The 2010 MARPOL Annex VI amendments to reduce SOx and NOx emissions continue to evolve as GHG reduction efforts progress.  United States ballast water treatment implementation schedules are progressing while the international convention awaits full ratification and the European Commission considers their approach.  The Maritime Labour Convention 2006 comes into force in a few months.  The North American ECA is now into full enforcement and the Caribbean Sea ECA comes into force on January 1, 2013 with full effect a year later.  The revised MARPOL Annex V is now in force and creating increasing pressure on port and terminal reception facilities.  The U.S. EPA revised Vessel General Permit comes into force on December 19, 2013.
        
“Challenge”: Ship owners and managers must ensure compliance with these new and evolving international and regional regulatory requirements in a continuing difficult economic environment. While there are clear environmental benefits, compliance with these new requirements requires significant capital expenditures and creates additional administrative, maintenance and training costs that must be borne by ship owners and managers. Flag Administrations, Classification Societies and regulatory agencies must expend time and resources to implement and enforce compliance with the new requirements. Implementation aboard ship is a challenge in itself.

“Priorities”: Overall, what are the priority issues that ship owners and managers, Flag Administrations and Port State Administrations must address to implement these new and evolving regulatory requirements in a manner that realizes environmental benefits but also allows implementation flexibility for ship owners and managers.


The Conference Goal
The Conference goal will be to develop a consensus on these issues and others as developed by the Conference speakers and attendees. The unique Mare Forum format, which emphasizes debate and discussion, will provide attendees with the opportunity to learn about, debate and influence the resolution of these and other questions with senior policy makers from industry and government.
